My elderly mother was recently divorced in Washington state. She now resides with me in Virginia. She is not receiving her monthly support payments from her lawyer's trust account. Her ex-husband's lawyer has not transferred the 401k that she was awarded. How can I as GAL enforce her divorce settlement from another state?
The enforcement motion would be filed with the Court that issued it. You would then serve the party where they are now living. If they default, you can enter a judgment and then register it with the Court in the County/State they now reside in. Its called registration of a foreign judgment. Its best to use a local attorney because they will know the process and how to enforce it.
