I am senior international student and I got arrested for possession of controlled substances. The DA's office has proposed my criminal lawyer to either accept a 6 months ACD, which would expire after the OPT application deadline, or to accept an Act of Disorderly Conduct. Which of these offers will result better for me in terms of immigration (I'm also a B1/B2 Visa holder) and future job opportunities.
You have to disclose about your arrest, and attach all related documents. 6 Month ACD should not effect OPT, because it would not be considered crime involving moral turpitude.
It is not a bar to admission to the US, since it is not a crime involving moral turpitude.
