The registered agent address on file with the Georgia Corporations is out dated as they do not live there anymore. Do we sue the corporation and just use the P.O. Box on the court documents as that is what they have been reporting to the court. It seems that they are hiding behind this P.O. Box to keep from being served.
There are alternative ways to serve a corporation if after a reasonable effort you cannot serve the registered agent, such as service on an officer and service by publication. However, it can complicated quickly and it depends on the facts. Retain a local attorney to assist you. It has to be done right.
Call the GA Secretary of State Corporations Division at 404-656-2817 or 478-207-1498 and inform them of the situation. They may be able to help you. Or, it may be their corporation does not legally exist any more (lapsed registration), in which case you may be able to sue whoever you dealt with.
If you found my answer useful, please check it as "helpful" here on Avvo. Answers to questions on Avvo are for general informational purposes only. Proper preparation of a bankruptcy case involves many factors and variables, and may lead to a different answer than that given here when all the facts are taken into consideration. The fact that a general question was answered on Avvo does not establish an attorney-client relationship; that only happens when both you and our firm sign a formal contract and a retainer is paid and collected.
I agree with both answers above, and to expand on your question: when the registered agent of an entity does no longer resides at the listed address, or the entity fails to maintain a registered agent, substituted service may be effectuated upon the Georgia Secretary of State under certain conditions. The SOS website has some useful information for substituted service.
If you have not done so already, you should consult with an attorney to make sure, among other things, that you are filing suit against the correct legal entity. An attorney can also help you accomplish service by an alternate method.
