When I lived in NY, I filed a complaint with the DOL a few years ago. They opened a case and began an investigation. My former employer did not cooperate, so the DOL told me that they would file for an Order to Comply back in December of 2018. I have contacted the person assigned to the case AND his supervisor. Last I heard, they are waiting for some "chief" to approve the Order to Comply and there is no time frame of when this could happen. I got the standard "We will let you know" and nothing else.
In October of 2019, my husband and I moved to Ohio. We provided the DOL with our new address and asked for an update regarding the case. I have repeatedly requested this information, asking why it is taking so long (after all, they assured me that everything would be completed within one year). Nobody responds to any emails being sent. I am sure they are just jerking me around.
If it is within the power of the DOL to do or not do something you do not have much of a claim here. If you do have a claim against your former employer than make it in the courts
The wheels of bureaucracy turn slowly. Laypeople are too quick to see a conspiracy when they don't get instant results.
