Judge made a ruling to follow PRE report. Judge and PRE stated I should have access to certain information. I e-mailed my ex and their lawyer over a week ago requesting a complete list of care provider names and contact information as well as regularly scheduled doctor appointments for the children. (per court order stating parties shall promptly provide each other with the names and full contact info of anyone providing these services to the children) My ex has not replied to this e-mail. The PRE report stated clearly that neither of us is to ignore communications from the other regarding the children, and in the Judge's order, it was made clear that I was to have access to all of their medical/health records and be listed as an emergency contact.
Also -order states children may contact me without restriction and my ex has not been allowing this. Order states if I call the children and they are unavailable, call should be promptly returned -my ex has NEVER allowed this.
What can I do? How long is a reasonable amount of time to wait before doing whatever it is that I can do?
The order states: "...each party shall promptly reply to all communications involving the children..."
You could file a motion to compel. Do you have another hearing set? If so, you can notify the judge at that time. A motion for contempt is also a possibility. However, contempt actions take months and I doubt you want to wait that long.
The answer given is not legal advice and does not imply that an attorney-client relationship has been established. Your best course of action is to have legal representation in this matter
Email them and give notice of the problems. Give a date by which they have to fix it or you will go back to court for contempt proceedings. Then do that. One week is plenty of time for them to fix things.
