Misdemeanor citations are in the discretion of the police officer. It normally occurs with minor offenses where the officer believes there is no need for you to go thru the formal arrest process and possibly have to make a bond. There is no such thing as qualifying for a citation. if you have 2 failure to be booked, you will be considered a capias where you could be arrested if they are not set aside within 7 days of when you were suppose to appear. A criminal citation is issued under the cite and release statute. The police check your record to see if you have a record of not showing up to court as ordered like the failure to be booked. Based on your record , you will probably always be arrested .
The misdemeanor citation statute states eight examples of when an arrest should be made instead of issuing a citation. Often officers do not follow that rule. It may be that your previous arrests fell into the eight exceptions (Like Domestic violence, shoplifting, etc.)
