My ex husband only has 4 to 6 hr visitation every other weekend and no overnight stays. We have 3 kids together. 14 and 15 yr old girls and 10 yr old boy. I know my girls have the ability to make a decision on what they want. I was advised to have them write a letter to the judge and also have the judge speak to them. Can you pls advise.
Judges don't like to have the children involved in the actual court proceedings, but sometimes they will allow it. You're correct that your oldest children could potentially speak to a judge. If you have a pending hearing, you can request that the children speak to the Judge in your paperwork. If you don't' have any pending hearings, you would have to file a Request For Order to Modify a current custody order based on some new information warranting a change in custody. It is a high standard to meet depending on what stage of your case you are - pending divorce, or pos-Judgment.
