Looks like i may be going to trial, facing a “gross negligent discharge of a firearm” and “access to a firearm while under the influence of a controlled substance.” The problem is that the police department has been withholding all body worn camera recordings (approx. 15 ) for 18 months; I believe the content of the recordings not only do they exonerate me, but more importantly, it incriminates police officers in misconduct, excessive use of force, and perjury. Is withholding evidence in the form of body worn camera recordings a serious offense for police officers? They also lied to the DA’s office stating they weren’t wearing body cameras, when we have evidence in the form a video that shows that LE was wearing body worn cameras.

There are several steps that your defense attorney will want to take, beginning with a motion to compel discovery, possibly a motion to suppress evidence, and possibly a motion to dismiss for outrageous government conduct assuming the extent of the misconduct you claim can be established. The facts regarding law enforcement's conduct may also be established through cross-examination at the preliminary hearing. You should contact an attorney immediately to begin laying the groundwork for your defense.
