I am in the process of a divorce after a 26yr marriage. We have agreed to just take our own belongings, our own retirement and our own debt. Our kids are raised so no child support involved. The only issue is the house equity, he owes me $20,000 because he is keeping the house. Normally I assume he would refinance or sell to five the money but his credit is so bad he can't even tho he has a well paid job. I told him he needed to sell then so we had an inspection of the house and we would have to invest at least 10,000 into the house before it would sell due to foundations issues. He would stick me with at least half of that. So I agreed to let him pay me out the $20,000. I am just trying to safe guard myself if he doesn't pay me like we agreed to. What can I do?
First thing is do not attempt to do a divorce with these issues without an attorney. Hire an attorney and they will help to protect you.
