I am on ssi for depression. Last year I received an inheritance but haven't claimed it yet because I want to put it in a special needs fund so I don't lose my benefits. I hired a lawyer last year that was recommended by the San Francisco bar association. It has been a year and there has been no progress. He told me things will go smoothly if we file in San Bruno which is the county next to San Fran where I live. Since I couldn't find a trustee that I could trust he offered to be my trustee (as well as my lawyer.) After filing it was denied because they didn't want my lawyer to be my trustee as well. He then handed me over to a different lawyer with no explanation. after about two months the new lawyer handed me back to my original lawyer saying that "the matter" cleared up and he will be able to take it from here. It is unclear to me what "the matter" was. It has been two months since I was passed back to him and he still hasn't returned my calls. I have been patiently waiting for almost a year and I've had it. I think it would be a good idea if found a different lawyer. As well as my question above can you offer any insight into my lawyers behavior/performance?
I know you must be frustrated.
I would call your current attorneys office and make an appointment-don't leave a message and wait for a call.
DEMAND an appointment and have a face to face meeting to get the answers you need.
If the attorney is not interested at this point-see if they will refund your money and give you a referral for someone to complete your case.
The answer given does not imply that an attorney-client relationship has been established and your best course of action is to have legal representation in this matter.
You should feel comfortable that your attorney is working for your best interests ... particularly if they will be serving as your trustee. If you are not comfortable, you should seek the advice of another attorney. There are trust companies and trust departments of major banks that will serve as professional trustees. Its important that you understand that you have some choices here. You do not have to accept poor client service - there are other attorneys who can help you. Good luck.
Contact your current attorney, demand face-to-face meeting to explain status and expedite matter.
