I have gone to the police and they won't do anything because there was no money involved. Went to the District Attorney and talked with investigator and and he has not gotten back with me after almost 2 weeks. Do I have to take her to civil court? On top of this she is having us evicted and it is in appeal. Do I bring this up at the appeal for my defense?
If you did not sign the lease renewal that makes you a month to month tenant, and you have to vacate as long as the landlord is not willing to extend your tenancy without a lease. So, you are not going to fare will on that issue in your eviction appeal. As for the forgery you can take the case to the same constable's office where your eviction took place. The constable's office is a law enforcement office, and if the city and district attorney are not helping you maybe you can convince the constable to file charges.
