I was convicted of a wet reckless in January 2016. I have the court docket and on 1/5/16, it says, "Defendant placed on summary probation for a period of 36 months". I was irresponsible and didn't get my classes done so on 1/5/17 I went back to get things back in order, and the docket reads, "Court finds defendant in violation of probation. Probation reinstated. Probation is continued on same terms and conditions." Just over 3 months later on 4/21/17 I turned in all my paperwork for my classes and community service and paid my fines.
Now, 35 months later, I'm applying to nursing school, and I'm being told that some hospitals/facilities may not allow me to do my nursing clinicals with them because of this conviction - they run background checks on all students. I'm scheduled to start nursing school in June of 2020, which will be 5 months past my 36 month probation period, from 1/5/17 (I'm assuming the 36 month time period restarted). I was wondering if anyone knew how to go about getting this expunged, and if the violation of probation could make that harder to do? I have a squeaky clean record otherwise. Please help!

If you file a PC 1203.4 Petition for Dismissal keep in mind that if you are arrested and convicted of another DUI within 10 years of the wet reckless, you will still be treated as a repeat offender and the penalties will be applied according to the standards for a second offense DUI.
