Collection agency sending documents that have falsified court seals to my(H.R) employer for a wage garnishment. Wages are being garnished and sitting in a reserve account at my place of employment. I checked the county and they have no record of these documents. I am needing to file an answer, but with nothing on file for this case I am unable to do so.
An easier path might be to contact the division of the state attorney general's office that investigates complaints of consumer fraud. Hope this perspective helps.
Bring the documents to a consumer attorney immediately. If the documents are in fact phony this violates the Fair Debt Collection Practices Act as well as other laws.
If the documents are falsified, you have experienced a violation of the Fair Debt Collections Practices Act. Bring all your papers to a consumer protection attorney ASAP.
Although AVVO describes this site as providing free legal advice, it is really a simple Q&A forum. The volunteer attorneys provide general answers. No specific legal advice is given here and no attorney-client relationship is established. For precise direction and legal advice, please consult in person with an attorney in your area. Be sure to bring all relevant paperwork with you.
