We paid $1900 for a vehicle before getting it inspected (stupid, I know). When we went to pick it up a few hours after test driving it there was a huge leak of antifreeze. We called the seller and he came back and told us there was plenty fluid in the engine for us to drive it home. I told him I wasn't comfortable doing that so he drove it to his house to work on it. He ended up taking it to a shop and told us they found a leak and fixed it and we could pick it up the next day. I called the shop and they told me they fixed the leak only to find another one and the radiator needed to be replaced. I asked if they were going to do that and they said the seller was picking it up without doing the repair. I assume he is going to try to turn the car over to us without disclosing or fixing the problem. At this point, I would just like to get my money back, but my daughter signed an as-is disclaimer. Is there any hope?
The definition of "as is" IS "no warranties of any kind." The phrase as is, is an industry term (mostly) for folks who sell things professionallly to "disclaim" warranties. The phrase "as is" is NOT a "commit fraud free" card...
