My ex husband passed away and I am trying to get my sons Indian card. I notised my ex deceased husband is not on the birth certificate!!! We even received SS for my son after his father passed away and in our divorce he was ordered to pay child support. I need to have my son's birth certificate amended to have his fathers name added. Do I need to go to court to do this?
The Superior Court might have the power to issue an order regarding an amendment to a birth certificate, but you might have to provide proof.

Yes you will need to go to court -- it's likely to be complex given his death, so if you can hire counsel to help you, do so.
