I need a lawyer who is used to dealing with the VA. My husband went to jail on 2-14-14 and has been receiving disability from the army since. I filed for an apportionment immediately to help provide for my son mostly but figured I should be entitled to a portion since we are still legally married and have totally gotten the run around. I even contacted our Senator in hopes that would help. He served over a year in jail & pleaded guilty to charges. He is now a registered sex offender (he was arrested in an undercover child sex sting operation). His mother blocked me out of his bank account. I just received a letter stating I would not be receiving our portion because my husband is in more need of it. Total injustice. I've been in total financial hardship ever since, lost my home & car.
You file for the apportionment by presenting a valid support order to the VA--they'll honor it.
