I was charged with a DWI, my lawyers managed to pull it down to an Obstruction of Highway, which I understand can be expunged. I’m about a week away from the end of my probation and would like to get the process started as soon as possible. Where do I begin? What steps do I need to take?
DWI's reduced to Obstruction of Highways and placed on Deferreds cannot be expunged in Texas. At most, depending on the underlying facts of the DWI, you can apply for a non-disclosure. A non-disclosure prevents the general public and private entities from running a background checking and seeing the Obstruction of a Highway, but law enforcement, government agencies and licensing agencies will still be able to see the arrest, the resolution of the case, and the dismissal.
