I'm trying to obtain new car insurance. While divorcing, I had an accident while still under ex spouse car insurance. Now the new company is asking for the accident information but since it was under ex spouse insurance policy the old company will not give me the information. Can't the new auto company obtain this information anyway if ex spouse won't release it to me?
They are playing games, it is all online, go to another company as there are thousands online to which to choose.
If you were a named insured, you have a right to the policy information. If not, then you cannot compel the insurer to give the info, unless your ex will give you an Authorization allowing the release of information to you.
I am not your attorney and don't know anything about your problem. Do not rely on my response other than as information used to hire an actual attorney.
If you were the named as an insured on the policy, then you should just contact your ex's insurance company to obtain this information. Also, you can always get a copy of the police report for the new company.
