my daughters real father is supposedly moving to flordia next month and he said he would give his rights up to her how do I go about doing that
This would be considered a Stepparent Adoption. Your daughter's birth father would consent to the adoption and sign away his rights via a form. I would advise you to retain an experienced family law attorney who practices Adoption law. Though a person can go through the process on their own there are many pitfalls and the clerk's office (the quasi-judicial body that does Adoptions in NC) expects all forms and other documents (affidavits, various motions/orders) to be 100% correct. The competitive rate for a Stepparent Adoption is anywhere between $1,500 to $3,000 per child. If a homestudy has to be completed you will have an additional expense having either the county's Department of Social Services (DSS) perform the study (approx $300 - $400) or a private agency (costing about $700). It should be noted that once the adoption is completed the birth father will no longer be obligated to pay child support.
There are forms available that you can download from the DSS website, but it is not as simple as that. You can try and represent yourself, but you should at least consult an experienced lawyer first. Even as a practicing lawyer, there are many legal tasks that I do not try to do myself. I pay another lawyer to do those things for me.
