I was arrested for PI in Dekalb County GA. My court date is in a month. What should I do if I want this record expunged? This was my first offense other than traffic violations.
If you have not already hired an attorney, you need to do so immediately. Your attorney can advise you on the specifics of your case as well as giving the best opportunity to fight the charge.
This response does not create an attorney client relationship nor should the advice be relied upon because it is not specific to your legal situation. Before you depend on legal advice, you should retain competent counsel.
You may be eligible for treatment as a First Offender. This means that if you complete the terms of the sentence, for example 12 months probation, 40 hour community service, and no alcohol, then you may have the guilty plea removed from your record. The arrest will still appear on your criminal history. You should contact an attorney to handle this expungement after you complete the terms of the sentence, assuming you're going to plead guilty. If you go to trial and are acquitted, then you may apply for expungement as well. The process for expungement can be complicated and time consuming. Most attorneys charge very reasonable rates for this matter.
