My next door neighbor is a hoarder of junk and to hide it from the public he placed a fence across the front with a gate. The gate is partially on my property 3 feet, which is the access to the side of my house. I have asked him to remove it from my property both verbally and in writing but he has done nothing.
You may need to hire an attorney to get an order to remove the encroaching portion of the fence. It might be possible to exercise some self help in this regard, but the risk of getting sued if you aren't sure of the line or use an improper procedure makes me think you would do best to involve legal counsel.
