What does your lawyer say? That is the only person who has enough information to advise you about a dismissal. Ask your lawyer. If you don't have lawyer hire one. The fact that some of the drug is missing may be helpful or it may not. If it is gone because it was used in testing to confirm that it was an illegal drug, it won't help. If it is missing for some other reason it may help. But the mere fact that some of it is gone, by itself, is not grounds for a dismissal.

If your friend had an attorney in the beginning, the case may have been dismissed if the state didn't have the lab results at the first trial. I was successful in getting a case dismissed Friday when the states attorney asked for a postponement due to the fact that they did not have the lab results back yet. The judge did not grant them a postponement and the case was dismissed. Now that the state has found the drugs for your friends case may or may not be in issue that could be raised before trial. Your friend really needs an attorney now
