I need to know if there is a restraining order on my nephew.
If there is a restraining order it would be served on him. If he is unsure, he can contact the family division.
In general, he has to be served with a copy of the order. If he has not been served, then it is not effective on him. He, or you, can check with the local courts to see if anything has been filed.
This answer is not legal advice, and does not create an attorney - client relationship. This answer is for educational purposes only.
Your nephew should know because it has to be served upon him in order for there to be additional proceedings relative to it.
This answer does not constitute the establishment of an attorney/client relationship nor is there any guarantee that this advice will be completely effective in a court of law. A consultation, including review of court orders and other documents is necessary in order for me to give you proper advice and guidance.
