I quit my job and my former employer is refusing to let me pick up my tools.i went to the police station a couple times and they refuse to help me saying it's a matter for small claims court.how do I file charges against him for theft/conversion if the police wont help me and how do I file a claim in small claims court...the problem there is it's not really a small claim there are approx 40k in tools involved here
Small Claims Court in Jasper County only has jursidiction over cases up to $6,000 in value. If your tools are worth more than that, you will have to file your case in Jasper Circuit (or Superior) Court.
You will still have the same claims -- civil conversion and trespass to chattels -- as well as a possible tortious interference claim. The difference is that you are probably going to want to have an attorney represent you.
However, a civil conversion claim allows you to recover THREE times the value of your tools, PLUS your attorney fees if you win.
