My daughter made sexual allegations against my then husband and from that, all my children were taken from my custody and I was considered unprotective because I was adimit that it didn't take place. After about 15 months and her finally being place with a good psychiatrist and therapist, it was determined that the allegation were false. And with the help of her therapist, we were able to finally get the case dismissed and my kids returned to my custody. Is there anything I can do because although I am making this very short, they never investigated ANYTHING. CPS took her word and only her word, even the Police came out, investigated and determined she was not being truthful. My husband was never arrested, charged or questioned by CPS. They never even spoke to family, friends, neighbors.
I would suggest that you consult with a personal injury attorney in the Stockton/Sacramento area regarding how to proceed. You may also want to discuss this with a Family Law attorney to see if there are any immunities for CPS when it comes to their actions. They will argue that they were acting in the best interest of the children.
