Back in 2005 i took a 2nd student loan that my father co-signed for. In 2006 my mother and father went through a nasty divorce and it ended up that my mother would be fully responsible for both of my student loans. It is now 2012, 7 years later and my father is claiming that i forged his name on the student loan that he has absolutely no knowledge about despite the divorce settlement. The loan company never took his name off the loans and i have been struggling to keep the loans paid. He has currently filed a civil suit against the loan company claiming forgery that he "thinks" i've committed. I have never been in trouble with the law ever and i have no idea how to go about this.
I would suggest that you talk only with a lawyer about the incident. Refrain from talking to anyone else. If your mother agreed to keep the loans I would think there is evidence that your father knew about the loan back at that time and didn't raise forgery at that time. There should have been some disclosure in the divorce case where these loans were addressed. If he was trying to shift responsibility back then he must have known there was something to shift the responsibility for.
