My (insufferable) subleasee has not paid her rent for the current month because she cannot afford it....I offered her a few more nights (FOR FREE) in the den downstairs of my home so she would not be homeless, and she refused to leave the room she currently occupies. Our lease says I need to give two weeks notice, but since she is already in default, do I have to go with the standard 10 grace period for her to pay? I don't want her money at this point, just for her to leave. Or do I give her the 7 day notice even though the lease says two weeks?
You have to follow your lease. If the lease gives her more time, you must follow it. Give her the 14 day notice if you haven't already. When that is up and she hasn't moved, file for eviction and check the box for holdover. Her only defense is she has a long term lease that has not expired...which she does not have.
