I got severed court papers today for my daughter with a court date as the defendant on an injunction against harassment. The lady named Jessica has 3 daughters 2 of whom went to school with my daughter last yr. Just 1 goes now. Last yr the girls had an issue on the bus. Mom sent her oldest high school daughter to the bus stop to threaten and intimidate my daughter as she got off bus. I called the cops immediately. Report was made. We moved on. Well last week my daughter was verbally attacked and threatened this time by the mom and 2 older sisters walking home from bus stop. I call cops again. Same cop came did nothing girls agree to get along. Now SHE filed injunction against harassment. It has outrageous lies she told the judge and signed Under penalty of perjury. I called the cops both times. This lady has never came to me or the school with the things she claims in this court paperwork. This seems to be a retaliation against my daughter because I called the cops 2 times. My daughter is the victim here. Can Any attorneys help guide me? Do attorneys even work on a case like this? I think Jessica should all get in trouble for perjury, can she? Can I counter file on them
You cannot file a counter protective order in the same proceeding but you can file a separate one. You need to pay attention to this because it could affect your child being able to attend the school, possibly (It depends on how broad the order might be).
