If child support is ordered on my spouse under what circumstance is he no longer ordered to pay. Also is there a new law that says after five years he is no longer required to be ordered to pay
To collect back child support you can hire a private attorney and if the other side does owe child support and you get a finding of contempt against that person in court, they most likely will be ordered to pay you back the attorney fees you spent on hiring an attorney.
No law exists that after five years he is no longer required to be ordered to pay. Limitations exists for contempt of court two years after 18 or high school whichever is later unless the child is disabled which extends limitations. The only circumstance under which he is no longer ordered to pay is one of the ending events in the Family Code, death or removal of disabilities of minority, marriage of minor, 18, high school, entry into armed forces, or event ending the child's minority and right of support from parent. You collect back support by enforcement and withholding and other remedies.
