Essentially I'm being charged with Felony charge 11359 and 11360, Possession of Marijuana for Sale and Sale or Transport of Marijuana. My court date is in 20 days. I was in my friends car who also has his 215 and we both claimed ownership of the hash and bud, but he is only being charged with 11360. I live in California and have my 215 medical recommendation. I'm trying to get a lawyer somehow but I'm desperately poor. What's my best course of action, how should I plea? Also, whats the worst case scenario for my sentence?
Any help is appreciated, thanksWe also had a scale with us and the hash was in multiple containers. We had about a QP of hash and less than an ounce of bud between the two of us.
Possible jail time, how much was there? What a lot of attorneys don't know is that even hash falls under companionate use act. Its a defense.
But, this all depends on the amount.
Feel free to give me a call with any questions you may have. I'd be glad to give you a free consultation.
Don't plead anything and don't talk to anyone but your lawyer about the facts of your case. If you cant afford a private medical marijuana attorney, ask the court to appoint you an attorney and follow your attorney's advice. Good luck to you.
Your question was directed at getting legal help. At your first appearance ask for a public defender. The charge are potentially serious but you have a defense. I also doubt the prosecutor will want to take a case like this to trial. Were is s/he going to find a jury in which no one has smoked pot/hash?
My advise is to ask the court for more time to secure an attorney. Go visit some lawyers to see what they charge. If you cannot afford them, then on the next date ask for the public defender. Now during the time that the PD is preparing the case you need to save scrap and put away every penny for a lawyer. It would not be super expensive but would cost some.
Also, find an attorney with experience with medical marijuana. I have experience with medical marijuana, as do the other posters who answered your question. You location is too far for me and maybe too far for the others who posted here....but you should find a medical marijuana attorney.
I would be available to speak to you about your case, but I cannot accept employment as counsel because of the distance.
