My bf was convicted of DUI case #12-58 on 12/5/2013. Was given 5 yrs DOC all suspended with 2 yrs DOC probation, this was NOT deferred. They revoked 3 yrs on 12/03/2015. Now his driving record is showing conviction on 12/03/2015 & 12/05/2013. DPS is saying court clerk sent papers in for conviction on both dates. He only get 1 DUI. Both of them are the same case number. What do we do?
Make a written request for a hearing with DPS ASAP. The only issue will be to verify that the conviction information is correct.
If DPS denies a hearing, then you’ll have to appeal to district court.
Basically the court clerk messed up and sent an abstract when he was revoked. You can also contact the court clerk office and ask them to double check the abstracts sent. They can send a corrected one.
Just be aware that DPS issues can be pretty confusing. If you want to get it corrected with DPS, and the clerk doesn’t make the correction, you will likely need an attorney.
