Family members moved into a home without a written lease and making the homeowner uncomfortable as well as not contributing to any bills or mortgage. How can they be evicted ? Will a notarized letter to vacate be the first step ?
If there's no agreement for them to do anything (pay rent, help with groceries or chores) then they're a guest. Guests can be told to leave, and if they don't, their things can be removed and the locks changed. Call the cops if they come back.
Many times, though, there is some agreement to pay some limited rent, or perform some other task in exchange for staying with some relative, especially if it's a long term situation. In that case, a 3 day notice is required if they're not complying with the agreement; a 30 day notice is required if the homeowner just decides that they don't want the tenant there anymore. Then a complaint for eviction (forcible detainer) is filed in the Justice of the Peace court nearest the property.
