Our Uncle Mac Watson passed without a will. There are 5 nieces and nephews all full blood Watsons. His father our Papa who was a Watson married his wife who was a Lydia Nolen Cianceilo. She has a daughter by another husband who was a Cianceilo. Her daughter has long since passed leaving 6 children. We do not feel that they should inherit anything or at least not as much as we are. Because we are full blooded Watsons and they have NO Watson blood at all. Can we do something about this??
Assuming that Uncle Mac's estate is solvent (assets exceed liabilities), then one of the family members will have to be appointed by the Probate Court to serve as Administrator of his estate. That person will have probably need the assistance of an attorney to sort out the family relations and determine who gets how much, and also to assist with the probate process. Because your uncle did not make a will, the State has a default will written into its Probate Court. The estate will be distributed according to the law of your State.
