My cousin is the father of a 10 yr old, the mom and him aren't together, haven't been for 5 years. He moved out of town for a job a few years back, and took his son with him, the mother didn't complain, didn't worry about even seeing the child. He moved back in to town, where he has his own place, just him and his child. The mom doesn't see the child regularly, doesn't call, doesn't attend events the child is involved in, doesn't make any effort to be a part of her son's life at all. That went on for 6 years. Now all the sudden she called one day wanting to see him, the dad, knowing his son wanted to see his mother allowed him to go visit. She then took out DVO papers on the dad, removed him and everyone in his family from school pick up list, and is trying to get custody for whatever reason. She isn't a good mom, or a good person, she's on drugs, and doesn't supervise the child at all. The father has been the sole provider of the child from the time of birth, even in the absent of the mother for the past 6 years.
He has to oppose the DVO application. And then get paternity orders through the court with custody and support addressed. He may really want to get a lawyer.
He needs to hire a Domestic Lawyer immediately. The Domestic Violence action could have a negative effect on his custody claim if he has a permanent restraining order entered against him.
