This involves my niece. She has been living with a boyfriend for a couple of years. Lately the relationship has become strained. Today while she is at work he texted her to not come back and if she does she will be trespassing. She has a vehicle in her name only that one of his sons has been using. They have one vehicle in both their names. She has furniture and appliances in the house, which he rented before they became partners. She owned this property before they met.
You can file a COMPLAINT TO RECOVER POSSESSION OF PERSONAL PROPERTY in small claims court in the county in which the home is located. This legal procedure will assist you with getting everything back and avoiding any legal issues with law enforcement. I have included a link to the Complaint (it's a PDF fillable form) and included a Small Claims Court Guide. You may want to consult with an attorney before filing this case, but you do not have to hire the attorney to represent you in small claims court. The attorney can advise of your of the small claims process and how you should approach the case. This will put you on better ground when you go before the Magistrate.
