Hi, I have been recently selected in H1 lottery and my wife is currently on E3D with an EAD, how can she maintain her work status to continue her employment
She can maintain status by keeping to the terms of her current status, and starting work as an H1b once the visa is approved and change of status granted and effective.
The above is intended only as general information, and does not constitute legal advice. You must speak with an attorney to discuss your individual case.
Your H-1B, if approved, will not start until 10/1/16 at the soonest. Assuming you maintain your E-3 until then, she can keep her E-3D EAD. In anticipation of 10/1/16, she can look into changing into another nonimmigrant status allowing her work, such as an E-3, E-2 or L-1 of her own. Otherwise, she can seek a change of status to remain in the U.S. as your H-4 dependent, but wouldn't be eligible for work permission.
