I jointly own 2 homes, wife is currently living and has lived in one home. I moved to the other while going through the divorce process. She calls the police to have me put out when neighbors say they have seen me there. I am entitled to a place to live. I keep staying with family because the harassment has gotten so bad I can't deal with it. What can I do
This is not a Landlord & Tenant question but a Divorce and Separation issue. Therefore, I have moved it to the proper forum so that you can obtain helpful responses.
Unless there is a Restraining Order which prevents you from being in the house in which you are living, there is no basis to evict you and it is unclear why the police would respond to your wife’s requests. You need an attorney to help you deal with these issues. Perhaps you need a restraining order against her?
The police cannot restrict you from living in your home, unless she has obtained a restraining order.
Thank you for your question. I know how concerned you must be about not being harassed by your spouse while the divorce is pending.
The short answer is that the matrimonial court can enter an order protecting you from harassment and the New Jersey Prevention of Domestic Violence Act also grants you protection from harassment from your spouse. It is important to have an experienced family law explain to you all of the options available to you so that you can make an informed decision as to how to best proceed.
