My husband and I live in a house we pay month to month rent. My sister in law is not on rental agreement and has been living with us for the past 4 years with No job in that 4 years. Hasn't paid rent or anything ever. My husband lost his job April 2018 and in May 2018 I told her she has to start helping out. January 1, 2019 I told her she has to find a job and pay her first time rent March 1 if she wants to stay. its now almost February and she hasn't applied or had job interviews. Just want to know when March 1 comes and she has no job or pays rent, how do I legally go about this? Can I kick her out from verbal and my own written eviction notice.
It appears that she is your guest and not a bona-fide tenant. She has no legal right to be in your home, and you do not need to initiate formal eviction proceedings against her. Simply obtain a copy of your lease, contact the local police, and have her trespassed from the property with a warning not to return unless you or your husband invite her back.
