I was driving in South Bound Brook. I received a phone call that I ignored. The call came a second time. I put the phone on speaker phone and was pulled over before I could even speak. This is my third offense (the first was Feb 2014 and the second Nov 2014). What should I do to avoid having my license suspended?
The only way you can prevent your license from being suspended is to hire a skilled traffic ticket lawyer. South Bound Brook is not an "easy court" so you will need a lawyer who is familiar with the judge and prosecutor to make sure you get the best result. Remember a suspended license will not just prevent you from driving, but it will also increase your insurance rates when you do get back to driving by the tune of several thousands of dollars easily over the next 3 years.

The Cell-Phone Statute (N.J.S. 39:4-97.3) provides "For a third or subsequent violation, the court, in its discretion, may order the person to forfeit the right to operate a motor vehicle over the highways of this State for a period of 90 days." - see N.J.S. 39:4-97.3(d). Given your sentencing exposure, you should hire an experienced Municipal Court Lawyer. There are many good NJ traffic lawyers here on Avvo. There are a few ways to try to avoid the license suspension. First, license loss is not mandatory, but discretionary. Second, there may be plea-bargain alternatives that can be explored that do not entail license loss of the mandatory points. Good Luck.
Hire an experienced municipal court/traffic attorney for your best chance to avoid license suspension.

I am frequently in South Bound Brook and Judge Richardson is not known for his patience. He is nonetheless a very considerate judge and will listen to all arguments of counsel and he realizes the effect of a 90 day suspension . I would recommend you hire someone who knows that court, Judge and Prosecutor well. It may be possible to avoid suspension and your use may even present a defense under the statute.
You need an attorney. The suspension is up the the Judge the points are not. There is a defense as well. get a blue tooth.
Listen to the advice that Attorney H. Scott Aalsberg gave you and setup an in person consultation with an experienced DUI/DWI lawyer. The advice Attorney H. Scott Aalsberg has furnished to you is 100% correct. You need to immediately protect your rights and hire a DUI/DWI attorney. A quality attorney will only meet you in their office, because attorney client privilege will only protect you in person, but not over the phone or through the Internet. A quality attorney will never discuss your case over the phone or Internet.
