My wages are being garnished at $800 per month until I satisfy a balance of $10,600. When that is paid, can the garnishment be reduced to the normal monthly payment of $400? Also, how often can I request this modification? My eldest turns 18 two months after this debt is to be satisfied, and I'll only have one child to support. Any back support owed at this point, plus the reduced amount owed each month for the one child will be paid off at that rate long before he turns 18.
If the garnishment is being done by DCSE, they will back it down once the arrearage is paid, although it may take them a pay period or 2 to notice. You can call them if they don't change it. Once your eldest turns 18/graduates from high school you can ask for modification. If there has been a material change in circumstances (for example, you earn less through no fault of your own), you can file for a modification. There are no limits on how often you can file, but if your modification is denied it can, in the long run, work against you.
