I was returning back from England and got pulled over by a security Guard or Immigration Security Guard. And was told that on My record was a Misdemeanor from yrs ago and they had to check it out( this was In Denver Co)..How can I get this off my Record? Thank you
Depends on many factors that are not included in your description. Suggest consulting with a local criminal attorney where the misdemeanor occurred for more information.
You will need to repost your request in the Denver Colorado forum, as most Florida attorney's are not able to advise you how or whether you can seal or expunge a Colorado misdemeanor.
You should consult a criminal defense attorney in the Denver area who can help with this issue.
This answer is provided as a public service and as a general response to a general question. It is not meant, and should not be relied upon as specific legal advice, nor does it create an attorney-client relationship. The choice of a lawyer is an important decision and should not be based solely upon advertisements. Past results afford no guarantee of future results. Every case is different and must be judged on its own merits.
As mentioned, you need to direct your question to a Lawyer licensed to practice in the State of Colorado, because different jurisdictions/States have different statutes/rules as it relates to your issue. You should mention you are calling about a potential Sealing or Expunction of your record of arrest. Generally (at least in Florida), in order to be eligible for such relief, you must (1) not have been adjudicated guilty of the offense, (2) you must not have been adjudicated guilty of any other offenses during your lifetime, and (3) you must be able to demonstrate to the Judge a reason (some are specifically delineated in the Florida Statute) why you are seeking that relief. A Criminal Defense Attorney in Colorado can easily advise you in an initial consultation about whether or not you are eligible.
