My wife and I moved into our first apartment last October planning on moving at the end of July. We asked our landlord if we could sign a 10 month lease instead of 12, and he said he would let us out when we needed to move but asked that we sign the 12 month lease anyways (I trusted him so I did). Throughout our stay there have been many times they haven't held up their end of the lease: entering without notice, not providing cable as they said they would, not fixing roof issues that have existed since month two, several building code violations. We never complained and have been patient with them, thinking that if we work with them, they'll work with us. However, now that the time has come for us to move out they want us to pay rent for the month of August, even though we will be out by the end of July. However, this was never discussed when we initially asked to move out early. Just feel like I'm trying to be taken advantage of. Looking for some advice on what we can do. They've entered without notice several times but that was a few months ago and don't know if thats enough to get out of the lease now. Anything helps, thanks.
If the written lease that you signed says 12 months, then you are obligated for 12 months. If you don't pay, landlord could sue you, and that becomes a permanent court record. And even if landlord does not sue, landlord could make an adverse entry on your credit record, lowering your credit score and making it more difficult to rent from a landlord who checks. Try to work it out. Don't rely on any verbal promises when signing a written document.
