We live in California and moved into these apartments in July of last year. We have a 13 month lease but would like to try to get out of it. Since we moved in there’s been a ton of police activity here from someone going around threatening people with a gun, to someone murdering someone. Now my husband is finding bullet casings outside in the parking lot when he’s coming home from work. I’m pregnant and the stress of living here is too much, we also don’t want to raise a baby in this kind of area. Any way to get out of the lease?
The landlord has a duty to make the premises safe. Sounds like they are breaching that duty. Give notice and move. Your safety is number 1. The landlord may go after you for terminating early. Or you can be proactive and sue prospectively in small claims court to terminate the lease early. The small claims judge has that power. Collect your evidence.
