she asks for my whole family's passport to make sure that none of us will leave the country and silly me i gave it to her...and has made the judge let her keep it during my divorce proceedings...now that me and my husband has cancelled our divorce ,do i have the right to get it back or do i need a court order so she can give it to me?
If you lawyer no longer represents yo,m then you are entitled to get all your original papers - including your passport - back. If you lawyer refuses, you have options. But it seems like you have not even asked. You need to ask your lawyer for your passport and other documents.
Ask your lawyer for the passport. As the divorce is over the restriction by the judge to have your lawyer hold the passport is also of no force and effct. You are entitled to all matters contained in your file.
Just ask for it back. The lawyer's right/obligation to hold the passport ended when the case was dismissed.
