Recently left a bad situation with irresponsible roommates one also being an ex best friend. My roommates are having issues getting their co-signer approved and now the property company is saying my Dad’s name won’t be taken off the lease as he is also bonded to renewals of the lease I originally signed with him. I have not yet signed the move out form so my name is legally still on the lease as well. If I refuse to sign the move out form or lease renewal form would this free my father of being the co-signer? Legally with my name still on the lease they would need all of us to sign the renewal? Would my roommates options then be to start a completely new lease or move out if they aren’t approved? There is only a month left on this lease by the way.
This is a landlord-tenant question. I posted an answer in your landlord-tenant post.
All good luck to you.
I represent lenders, landlords and creditors. This answer is based on the viewpoint of a creditors-rights attorney. It's possible that a debtor / tenant / consumer lawyer would provide a different answer or focus on different nuances of the situation. More importantly, it is impossible to provide a reasoned legal opinion in response to any brief internet writeup. My response here is not, and is not intended as, a reasoned legal opinion or legal advice to anyone, including the person who posed the question. Even so, I hope that my comments are some help.
