I was given a job just recently at another walmart and it was taken away because of another walmart I worked at over 7 years ago when I was terminated it was for not washing my hands they let me go stating I could be rehired I was told today that they put gross misconduct on my file I had 2 couching because the new manager in the fresh area did not like me he was always trying to schedule me when I was not available he gave me attendance points for days I was approved for vacation stating that he did not approve the days even though they were by HR I got hurt my hand was burned I could not work with food took leave of absence because my hand was bandaged he took that against me because of these things john mahugum at Wal-Mart on Kearney now has withdrawn the job offer and told me that he wrote gross misconduct and has black balled me from ever getting another job at another walmart permanently
There is no provision for requiring an employer to remove information about you based upon your prior work history generally. You could have submitted a service letter request within one year of leaving that employer but since it was seven years ago it is too late to pursue that now. I do not believe you can even pursue slander/libel against the former boss as the law does not consider it to have been published to a third-party so long as the information was only disseminated amongst Wal-Mart employees.
Perhaps another attorney has some bright idea that might help you in this situation but I can't think of any.
