11:30 pm at night I was traveling east on a street (street is 1 lane east and 1 lane west I made a right turn onto a 1 lane street pulled over and got a ticket How is this possible I plan on fighting this in court. Any advise
Easy a cop can give you a ticket for anything. If you think you did nothing wrong, I would first make a demand upon the prosecutor for the discovery specifically for any video or officers notes as you don't want to say you did nothing wrong and then they show a video of it. Lastly if it is important to win, I always suggest a lawyer as it gives you the best chance of winning, it may cost a lot of money for a good lawyer, but losing can be more expensive.
Yes. Take pictures, Get a map of the area from the town (maybe the tax office) showing only one lane. The law is to make the turn as close to the right as possible and not to swing left first. Can't say there. See if there is video. ( even if there is it gets reused in 30 days or less-move fast- ATMs, stores, town cameras at a light)Try to have the trial over 30 days after the event, since the correct ticket (which has more potential points- the cop may have been giving you a break in his way) can be written for 30 days. Or go in and negotiate a 0 point ticket (not unsafe driving since that has $439 fine) with the prosecutor and save effort, time (likely more than one court date if a trial) and the potential points if you lose.
