A good friend of mine who is like a sister to me recently found out that someone has created a fake profile in her name on both "Fuckbook" and "Pornhub". She is absolutely distraught and feels violated. It appears the individual has used her Facebook pictures and added some perverse XXX ones that are not her. What can be done to get these sites removed?
She should feel violated but this is the dark side of posting to Facebook. There are several techniques which may work to get the profiles removed. The first would be to notify the sites and request that the profiles be removed. That might or might not work. Second would be the have the pictures removed by serving DMCA notices. The sites are not legally required to remove the pictures if the notices are served but most will.
The next steps would need probably require litigation to force the removal and to reveal the IP addresses used to set up the profile. If she know who did this there may be additional avenues of attack.
Good luck to her.
If sending a DMCA notice to the web site does not work; consider hiring a lawyer to send a Cease and Desist letter.
A C&D letter from a lawyer on their stationary will tell the offending site you are serious about pursuing your rights and will often do the trick.
You may want to discuss your situation with a lawyer in more detail. Most lawyers on Avvo offer a free phone consultation.
