Married for 13 years with two children. My husband has cheated many times. In the past he has told me who and how long the affairs lasted and each time I look him back, but with this last incident he states he cant give me any information because it will jeopardize his career. He has said the affair is over. Please help
There are many people who are bad spouses, but good parents. Your comment implies the former. No where do you say that he is a bad father to your children. Having said that, the court will fashion a parenting plan that sets out timesharing for each parent, parental responsibility, child support, and other issues regarding the children. Payment of attorney fees is based upon one person's need, and the other's ability to pay. His extramarital affairs are not a guarantee of payment of fees. I wish you good luck
I agree with Ms. Brady-Alten, you have not stated any factual basis for "full custody". Shared parental responsibility has become the norm in Florida, and it is an uphill battle to prove that the other parent is an unfit parent. Just because he is an unfit husband, does not mean he is unfit as a father. Florida is a no fault divorce state, meaning that his infidelity will not likely be a factor in your divorce. The one exception is if he used family assets to further his affair.
As for the attorney's fees, the court can award attorney's fees based upon need and ability to pay. If you have been a stay at home mother and he has a good income, you are likely to be awarded attorney's fees.
