Last autumn my child mother filed for child support, after moving my child without my permission, when I supplied paystubs and receipts showing I had paid child support directly to his mother, to lower my arrears we were sent to a referee whom decided to raise my child support to more than I could afford to survive on what was left over. I contested the referee's decision in court to which the judge did not even look at the case but failed to inform me of how long I contest that decision, so now 3 months later, and 3 months of being unemployed with no unemployment just want it returned t the way it was before because a referee's hearing happened without being requested by either party. What can I do?
Hearings go to a referee as a matter of efficiency because the court system would be overwhelmed if judges had to hear and decide every single child support modification; the law provides that the referee’s findings and conclusions, though, can be appealed to a judge. It sounds like this process has played out, though, and that the time for further appeal or modification had lapsed.
